What is a Brand?
Your brand is more than a name or logo – it’s the identity and reputation that differentiates your business in the marketplace. A strong brand builds trust, loyalty, and long-term value.
Why Trade Marks Matter:
A trade mark protects your brand name, logo, or other distinctive signs against unauthorised use. Registration grants you exclusive rights and makes enforcement far easier than relying solely on passing-off.
Company Name ≠ Brand Protection:
Registering your brand as your company name only lets you use it for your registered business. It doesn’t stop others trading under the same name. A registered trade mark is the real monopoly right.
Registration Process & Costs:
From filing with the UKIPO to final registration can take 6–9 months, allowing for examination, publication, and opposition periods. Costs vary depending on classes and searches – a single UK trade mark in one class is typically £660 plus VAT, plus UKIPO fees. Comprehensive searches are advised before filing.
What Makes a Strong Trade Mark?
Choose distinctive, allusive (not descriptive) names or logos. Avoid terms common in your industry. Ensure no similar marks exist, list goods/services precisely, and use the mark in trade exactly as registered.
Types of Marks:
- Word marks protect the wording in any format.
- Stylised word marks protect specific fonts/colours.
- Device marks protect logos and graphic elements.
Risks in Similar Names:
Even if you target a different customer segment, another party’s trade mark could still block your use – especially if their registration is under five years old or if the court sees overlap in market segments.
Investor Due Diligence:
Investors want to see clear brand asset protection – registered trade marks, consistent use, licences where relevant, and an enforcement strategy. This signals a professional, investable management team.
